Adjacent Excavation
Section 6 of the Party Wall etc. Act 1996 covers adjacent excavation and construction where:
- Three Metres. If it is proposed to carry out excavation or piling within three metres of an adjoining owners’s building or structure and to a level below their foundations, the Act applies.

- Six Metres. If deep excavation or piling work is being carried out, within six metres of a neighbour’s building/structure, the Act may apply. This situation is perhaps more easily explained with the diagram below. (If it is proposed to excavate within a distance of six metres measured horizontally from any part of a buildng or structure of an Adjoining Owner and any part of the proposed excavation will within those six metres (6 metres) meet a plane drawn downwards in the direction of the excavation at an angle of forty-five degrees (45º) from the bottom of the adjoining owner's foundations, the Act will apply.)
